At the outset Mr.Jinsiwale states that there is an error in the number of days delay mentioned in the application. Mr.Jinsiwale states that the delay is actually 437 days and not just 30 days. Leave to amend the Interim Application granted. Amendment to be carried out forthwith. Re-verification dispensed with.
Applicant was a pedestrian who was run over by a motor vehicle-a lorry, and the left wheel of the lorry went over the right leg of applicant. Applicant suffered serious injuries and was in hospital for a long time. Applicant's right foot appears to have been completely crushed. In the application it is explained that applicant has spending substantial amount on her treatment and she is unable to even travel without assistance. The explanation for delay is stated in paragraph 3 of interim application. Appellant who is Respondent in the Cross Objection filed by applicant, has not filed any affidavit-in-reply
Rajeshri Aher 3/3 18 ia 3236 of 2020.doc opposing the interim application. In view thereof, and having considered the Interim Application, we are inclined to condone the delay. Delay condoned.
