Leave was granted in appeal against acquittal and action under Section 390 of Cr.P.C. was initiated. This application is preferred by original accused seeking modification of order dated 21.03.2018 passed by this Court to the extent that direction of furnishing sureties may be relaxed by permitting the applicant to furnish PR bond and direction of furnishing local sureties be exempted.

The acquitted accused is represented by advocate and hence modification as sought by the applicant can be granted.

ORDER

(i) Interim Application No.1079 of 2020 is allowed. (ii) Order dated 21.03.2018 passed by this Court is modified and applicant is permitted to furnish PR bond by relaxing the other conditions in connection with exemption under Section 390 of Cr.P.C.

(iii) Compliance shall be done within a period from 6 weeks from today.
