The Petitioner, Shri Rajendra Kalicharan Verma, who also claims to be an advocate is arguing this matter in person. He makes request for adjourning the matter.

The orders impugned were passed in 2015 and the present proceedings were pending before this Court and adjourned from time to time at the behest of the Petitioner. As such, the request for grant of adjournment is rejected. 3.

So far as the question of hearing of the matter on merits is concerned, the Petitioner is challenging the orders of the Learned Magistrate and the Learned Sessions Judge rejecting prayer for discharge. V.A. Tikam 1/2

I have gone through the record and also through the impugned orders and it has come to my notice that the Learned Trial Court has already framed the charge against the Applicant/Petitioner.

That being so, both the Courts below, in my view, are right in law in rejecting the applications for discharge as prayed by the Petitioner. Once the charge is framed, the prayer for discharge cannot be considered. 7.

In that view of the matter, I do not see any reason to interfere with the impugned orders passed by the Trial Court as well as the Sessions Court. Hence, writ petition No. 1405 of 2015 stands dismissed. [NITIN W. SAMBRE, J.] V.A. Tikam 2/2
