Learned APP, on instructions, states that the trial has commenced and that out of seven witnesses, three witnesses are already examined.

In view of the statement made by the learned APP, learned counsel for the applicant seeks leave to withdraw this application. 3.

Considering the peculiar facts of this case and having regard to the age of the applicant, i.e. 78 years, the trial of the applicant is expedited.

Rekha Patil 2/2 903-BA-969-2019.doc The learned Trial Judge to conclude the case as expeditiously as possible and in any event within three months from the date of receipt of this order. The prosecution to ensure that the witnesses and the accused are produced on the dates given by the trial Court.

In the event, the trial does not conclude within the said period, for no fault of the applicant, the applicant is at liberty to file a fresh bail application.

The application is accordingly disposed of.
