Though the Appeal is admitted by order dated 22.10.2002, it was on board dated 21st December, 2023. This Court on that day dispensed with printing. On a request of advocate, time was granted to contact his client and Appeal was adjourned to 11.01.2024. On 11.01.2024, learned advocate for the Appellant informs that he could not establish contact with the Appellant for taking instructions. The Appeal was thus adjourned to today. 2.

Today, when the matter is called out, none appears. It seems that the Appellant is not interested in prosecuting the Appeal. As the Appeal is filed challenging order of dismissal of suit for declaration and injunction, the Appeal is pending without interim relief. It appears that the Appellant is not interested in prosecuting the matter. This Court is therefore constrained to pass order for BGP.
