The above Family Court Appeal is filed by the appellant - wife impugning the judgment and order dated 11.1.2017 passed by the Family Court, Thane dismissing her petition seeking divorce.

The parties have now agreed to unconditionally withdraw all the allegations made against each other and obtain divorce by mutual consent. Parties have also agreed that they will not make any claim of maintenance and no

17. civil fca 137-17 & cam 201-17.doc orders are required with regard to their son who is 32 years old. Under the circumstances, the following order is passed:- (i) The parties shall move the Principal Judge, Family Court, Thane on 9.7.2019 at 11.00 a.m. along with an application / petition seeking divorce by mutual consent.

(ii) The learned Principal Judge, Family Court, Thane shall on the same day without directing the parties to take out notice of motion after a period of six months, pass a decree of divorce by mutual consent.

(iii) All the allegations made by the parties against each other stands withdrawn.

(iv) Statement made by the parties that they have agreed not to claim any maintenance is accepted. 3.

In view of the above, Family Court Appeal is disposed of. Civil Application No. 201 of 2017 also stands disposed of. [ S.J. KATHAWALLA, J. ] [ AKIL KURESHI, J ]
