Petitioner claims that all accused persons named by him were not arrested and as such there is no custodial investigation. 2.

Learned APP states that proper investigation was carried out. Raju Bhosale and Chota Robert named by the petitioner were found to be present elsewhere and not at the crime scene and hence no charge-sheet is filed against them. Charge-sheet is filed only against two other persons and 7-8 unknown persons.

Papers produced by learned APP shows that 2 accused persons against whom charge-sheet has been filed were arrested and are in custody.

As such we cannot at this stage appreciate the contention of the petitioner.
