Mr. Tajane, learned counsel for the petitioner, at the outset, restricts this petition to the relief claimed in prayer clause (b) which reads as under :

"(b) The Respondent No.5 and 10 be directed to take action against the unauthorized construction on land admeasuring 6R out of old Survey No.45/1+1+2 and new Survey No.62/1 situated at Mauje Rajgurunagar, Tal-Khed, Dist-Pune as per the complaint of the petitioner dated 04.12.2014, 04.04.2015, 09.04.2015 and 15.03.2016." 2.

Mr. Tajane, learned counsel for the petitioner, submits that the grievance of the petitioner would be substantially redressed if the SubDivisional Officer-Khed, District Pune, decides the petitioner's representation dated 4th December, 2014 , a copy of which is annexed at "Exhibit-M", page 105. Mrs. Thakur, learned AGP, submits to the orders of this Court.

In the light of the above, we deem it convenient to dispose of this petition by directing the respondent No.5- Sub-Divisional OfficerKhed, Rajgurunagar, Taluka - Khed, District - Pune, to dispose of the petitioner's representation dated 4th December, 2014, a copy of which is annexed at "Exhibit-M", page 105, as expeditiously as possible and preferably within a period of three months from the date of receipt of this order. Ordered accordingly.

It is made clear that we have not gone into the merits of the matter and all rights and contentions of the respective parties are kept expressly open to be agitated before the concerned authority who shall decide the same independently on its own merits and in accordance with law.

In order to enable the respondent No.5-Sub-Divisional Officer -Khed, to comply with this order, the petitioner shall personally remain present before him along with her representation as well as copy of this order on 7th May, 2018, at 11.00 a.m..

The writ petition stands disposed of.
