DATE : 4TH SEPTEMBER, 2018 P.C:- 1) The above applications are filed by the aforesaid applicants for pre-arrest bail, under Section 438 of Criminal Procedure Code, apprehending their arrest in C.R.No. 47 of 2018 of 2018 registered at Pandharpur Taluka Police Station, District Sholapur for offences punishable under sections 306 and 506 read with section 34 of the Indian Penal Code. 2) Heard Mr. Aniket Nikam learned counsel for the applicant in ABA/605/2018, Mr. P.G. Chavan, learned counsel for
the applicant in ABA/625/2018 and Mr Rajan Salvi, learned APP for the State. Perused the records and considered the submissions advanced by the learned counsels for the respective parties.
3) The record reveals that by an order dated 27th March, 2018, this Court after considering the material on record and particularly the allegations against the applicants had granted interim bail to the applicants, in both the applications. By the said order the applicants were directed to report to the Investigating Officer as and when called. The learned APP submits that the applicants have cooperated with the investigation, the investigation is completed and charge sheet is also filed.
4) Considering the above statement, in my considered view, this is a fit case for grant of pre-arrest bail. Hence, the following order :
i) In the event of arrest in Crime No. 47/2018 registered with Pandharpur Taluka Police Station, District Sholapur, the applicants be released on anticipatory bail on their furnishing bail bonds of Rs. 25,000/- each with one or two sureties in the like
amount to the satisfaction of the concerned Investigating Officer.
(ii) The applicants to co-operate with the conduct of the trial.
(iii) The applicants shall furnish their permanent and temporary addresses, if any, and their contact details to the Investigation Officer. (iv) The applicants shall not change their residential address without prior intimation to the Investigation Officer and the Trial Court.
(v) The applicants shall not interfere with the complainant / first informant, other witnesses and shall not tamper with the evidence in any manner.
5) Applications are allowed in the aforesaid terms and are accordingly disposed of.
