Counsel for petitioner stated if the appropriate authority of respondent no.3 is willing to hear the matter afresh, the court may quash the impugned order dated 17th March 2021 and remand the matter for fresh hearing. Mr. Bubna, counsel for respondent no.3 the contesting respondent states that he has instructions to state that the Deputy Municipal Commissioner will hear the matter and court may quash the impugned order dated 17th March 2021 and remand the matter for fresh hearing. Accordingly, impugned order dated 17th March 2021 is quashed and set aside and the matter is remanded for denovo hearing before Deputy Municipal Commissioner of respondent no.3, who shall after giving an opportunity of personal hearing to petitioner shall pass such order as he deems fit in accordance with law.
