The above Criminal Writ Petition has been filed for quashing the FIR No. II 06 of 2015 lodged against the Petitioners under Section 7, 12, 13(1) (d) and 13(2) of the Prevention of Corruption Act, 1988. The Petitioner No.2 has been accosted whilst accepting illegal gratification allegedly on behalf of the Petitioner No.1 who is a medical officer working with Kalyan District Central Jail. Before laying the trap, the police has recorded the conversation between the Petitioner No.2 i.e. the acceptor of illegal gratification and the complainant i.e. the Respondent No.4 herein. The said conversion prima facie shows the involvement of the Petitioners in acceptance of the illegal gratification.

Having regard to the fact that the FIR has been lodged under the lgc

(32) wp-1345.16 provisions of the Prevention of Corruption Act, it is not possible to grant the relief sought by the Petitioners by way of the above Criminal Writ Petition. The above Criminal Writ Petition is accordingly dismissed. [SANDEEP K. SHINDE, J] [R.M.SAVANT, J] lgc
