This is an application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail.

The applicant came to be arrested in Crime No. 280 of 2020 registered at Yeola City Police Station, for the offence punishable under Section 394, 397, 341, 120-B r/w. 34 of Indian Penal Code. 3.

I have heard the learned Counsel for the applicant and the learned APP for the State.

The learned Counsel for the applicant has placed on record a copy of the order dated 16 November 2021 passed by this Court in Kanchan P Dhuri 1 / 2

73-BA-1316-2022.odt Criminal Bail Application No.3135 of 2021. By the said order, this Court has released the co-accused Satish Mali on bail. 5.

I have perused the charge-sheet. According to the prosecution, the present applicant and other co-accused committed robbery and while committing the robbery caused grievous hurt to the complainant. The allegations against the present applicant and co-accused Satish Mali are identical. Considering the facts and circumstances of the case, I am inclined to release the applicant on bail. Hence, the following order is passed :

(i) Application is allowed.

(ii) The applicant - Chetan Shashikant Pawar be released on bail in Crime No. 280 of 2020 registered at Yeola City Police Station, for the offence punishable under Section 394, 397, 341, 120-B r/w. 34 of Indian Penal Code on furnishing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount.
