Heard, Mr Upadhyay, the learned counsel for the Petitioner and Ms Shinde, the learned APP for the State. The Petition is filed seeking direction to Respondents to forthwith hold necessary enquiry against Jain Brothers, their accompanies and the police officer and to take necessary action in accordance with law.

The learned APP for the State placed on record report dated 10th April 2017 by the Senior Police Inspector, LT Marg Police Station. The report discloses that an enquiry is conducted into the Petitioner's allegations by the Assistant Commissioner of Police, Pydhonie Division, 1/2

jsn 25-wp-3872-2016.doc Mumbai. It was found that there was no substance in the Petitioner's allegations and accordingly complaint was filed. The report filed by the Assistant Commissioner of Police was also approved by Deputy Commissioner of Police.

In the light of above, we are not inclined to entertain this Petition and same is accordingly dismissed.

In view of dismissal of the Writ Petition, the Criminal Application No. 166 of 2017 will not survive and same is dismissed. (ANUJA PRABHUDESSAI, J.) (RANJIT MORE, J.) 2/2
