The respondent herein has filed the application before the learned Judicial Magistrate First Class for various reliefs including maintenance under the provisions of Protection of Women from Domestic Violence Act, 2005.

The learned counsel for the petitioner submits that in view of the directions issued by the Hon'ble Supreme Court in Rajnesh Vs. Neha1, the parties to maintenance proceedings are required to file the affidavit of assets and liabilities. It is submitted that the affidavit filed by the respondent is not in conformity with the direction issued by the Hon'ble Supreme Court. 3.

The petition is totally misconceived. If according to the petitioner, the affidavit filed by the respondent is not in conformity MANU/SC/0833/2020 Darshan P. Patil 1/2

23-wp-6335-23.odt with the directions issued by the Hon'ble Supreme Court then he can raise this point at the time of final hearing of the application and request can be made to the concerned Court to draw adverse inference.

I am, therefore, not inclined to entertain the present petition. 5.

Writ petition is dismissed.
