Heard learned counsel for the parties.

By this application, the applicant seeks permission to travel to Nigeria, for a period of six weeks, commencing 15th May, 2018.

Learned Counsel for the applicant submitted that this Court vide order dated 12th December, 2017, had permitted the applicant to travel abroad, particularly to Nigeria and that the applicant had travelled to Nigeria in February and had on his return, handed over his passport to the Investigating Officer.

Learned APP opposed the bail application. Learned Counsel for the original complainant also opposes the application. 5.

Perused the papers. The applicant was granted interim protection vide order dated 12th June, 2017, and his application for Anticipatory Bail is pending in this Court. Due to paucity of time, the Applicant's Anticipatory Bail Application, could not be taken up. In addition there are 25-35 new Anticipatory Bail Applications' coming up for urgent reliefs. This Court is also been assigned regular bail applications in addition to Anticipatory Bail Applications. Hence, interim orders get continued due to paucity of time.

As the applicant had earlier travelled to Nigeria and had returned his passport to the Investigating Officer on his return, the application is allowed on the following terms:-

ORDER

(i) The applicant is permitted to travel to Nigeria for a period of six weeks, commencing 15th May, 2018;

(ii) The applicant to furnish his address and telephone numbers, where he will be staying during the said period to the Investigating Officer, before leaving India;

(iii) The applicant shall deposit a sum of Rs.10 lakhs, in the Registry of this Court, before leaving India;

(iv) The police shall forthwith hand over the passport to the applicant, to enable him to complete all the necessary formalities. The applicant to produce the receipt of deposit of Rs.10 lakhs, before the police, before the passport is handed over to him;

The Application is allowed in the aforesaid terms and is accordingly disposed of.
