Learned counsel for the Applicant states that the application was allowed on 10 November 2014, however, the order was recalled subsequently since it was noticed that the second appeal has been dismissed for non-prosecution. She submits that the second appeal is now restored. Consequently, the civil application is allowed in terms of prayer clauses (a), (a1) and (b).
