Heard Mr.Girish Agarwal, learned counsel for the petitioner and Mr. Vikram Walawalkar, learned counsel for the respondents 3.

Mr.Agarwal states that petitioner Ramanlal Devchand Shah is present in the court. He has tendered affidavit dated 2.2.2016 made by the petitioner along with photocopies of Aadhaar card of the petitioner as also identity card issued by Election Commission of India. Affidavit and photocopies of Aadhaar card and identity card issued by Election Commission of India are taken on record and marked "X" collectively for identification. 4.

In paragraph 3 of the affidavit, it is stated that the petitioner and the respondent have settled their dispute out of

2 / 2 WP/3931/2015 court and the petitioner does not wish to pursue the present petition. Upon taking instructions from the petitioner, Mr. Agrawal seeks permission to withdraw the petition. Mr. Walawalkar submits that the respondent is present in the court and he has no objection.

In view thereof, on the motion made by Mr Agrawal, petition is allowed to be withdrawn and is disposed of as such. Order accordingly.
