Heard. By this Civil Application, the Plaintiff is seeking injunction against the Respondents from creating any third party right, title and interest in respect of the suit premises i.e. Room No.2, Mali Chawl, Mali Compound, Shanti Nagar, Kokani Pada, S.N.

Dubey Road, Dahisar (E), Mumbai - 400068 during pendency of the First Appeal.

After arguing for some time, the learned counsel for the Applicant submits that he received instructions from his client not to press the Civil Application. To that effect, he has given in writing. Same is taken on record and marked "X" for identification.
