Today, the matter is fixed for dismissal. The learned Advocate for the Appellant/Plaintiff is present and he expressed desire to argue the matter on the next date. The Trial Court decreed the suit of the Plaintiff for injunction. It was reversed by the First Appellate Court. The Second Appeal is admitted on 3rd October, 1995 by framing substantial questions of law as suggested in para Nos.2, 4 & 9.

In view of this matter be fixed for final hearing on 18th August, 2022.

For the last more than 14 years, this Application is pending. Pending final disposal of the Second Appeal, the Appellant/Plaintiff has prayed for an injunction restraining the Respondent from obstructing the peaceful possession of the Appellant. There are also further Interim reliefs. 5.

As on today, the suit is dismissed as held by the First Appellate Court. For all these years, the Application is neither pressed nor orders are passed on that. In view of that the Application is disposed of. [S. M. MODAK, J.] Kiran 2/2
