The Petitioner is working as Professor-Director in the UGS HRDC, University of Mumbai. The Petitioner has filed this petition on an apprehension that the Petitioner's services might be terminated before the Petitioner reaches the age of superannuation on 30 April 2024.

Neither there is any communication or notice is given to the Petitioner nor any enquiry is pending against the Petitioner regarding termination. In paragraph- 17 of the petition, the Petitioner has made certain general submissions that it was orally informed to the Petitioner by the Vice-Chancellor that the Petitioner

SKN 2 40-WP-6981.2023.doc may not be continued and that the Respondents are reconsidering the continuation of services of the Petitioner. 3.

In this petition, no reply is filed by the RespondentUniversity in spite of the fact that the petition is pending since 2023. Therefore, there is nothing on record that the Petitioner's services will be discontinued. The Petitioner holds a senior level post. The Respondent- employer is a statutory authority and if any discontinuation of services is contemplated, that will be on advance notice. Since there is no such notice, we find that the petition needs to be taken forward on mere apprehension, especially when no reply affidavit is filed by the Respondent- University. 4.

Writ petition is accordingly disposed of.
