Heard learned counsel appearing for the Applicant. This application is made by the Respondent in the Family Court appeal. The challenge in the Family Court Appeal is to a decree passed by the Family Court declaring the marriage between the parties as null and void. The prayer in this application is for stay of the orders passed by Family Court, at Pune in proceedings under Section 125/127 of Code of Criminal Procedure, 1973 (`Code'). There is no substantive challenge by the Applicant to the orders passed in the said proceedings. Therefore, no relief can be granted in this Family Court Appeal.

The application is accordingly rejected. However, it will be open for the Applicant to adopt appropriate proceedings in accordance with law for the relief which is sought in the present application.
