Heard learned Counsel for the appellant and the learned Counsel appearing for Respondent. It has been submitted that appellant is no more and he passed away in the month of January 2016. Learned Counsel for the appellant expressed inability to bring his legal heirs on record for want of necessary instructions. In view of death of the appellant, obviously proceeding came to be abated automatically after expiry of stipulated period. Therefore, no question arises to keep the present appeal alive on board for further process. Hence, appeal stands disposed of as abated. No order as to costs.
