This is an application for bail under Section 439 of Cr. P.C. in CR No.80 of 2014 registered with Bhandup Police Station, Mumbai under Section 457, 380, 427 read with 34 of the Indian Penal Code . It is the prosecution case that, the applicant along with other co-accused entered into the Company of the first informant Shri Shashikant Sharma and committed theft of steal plates and other industrial articles worth Rs.3,26,000/-. The applicant has been identified with the aid of CCTV. After investigation, police have filed chargesheet. It is to be noted here that apart from the preset crime, the applicant was also involved in
2/2 BA.721-2016 four other crimes. That he has been acquitted from two crimes and the trial pertaining to two crimes is still pending for final adjudication before the Trial Court.
It appears from the record that when the applicant was on bail in earlier crime, he has committed the present crime. In view of above, I am not inclined to release the applicant on bail. The learned counsel for the applicant submitted that the applicant is arrested on 18.3.2014 and there is no progress in the trial. In view of the fact that the applicant is in jail since 18.3.2014, the learned Additional Sessions Judge seized of Sessions Case No.527 of 2014 is hereby directed to make an endevour to complete the trial of the said case within a period of one year from today.
