This is an application for bail in CR No.365/2015 dated 24.12.2015 registered with Shivaji Park Police Station, Mumbai under Section 465, 467,468,471,420,419 of the Indian Penal Code. 2) It is the case of the prosecution that the applicant by submitting forged and fabricated documents of Shri. Chandrakant Patwardhan and Vaishali Bhandarkar opened an account in the Maharashtra State Co-op. Bank Ltd., Shivaji Park Branch, Mumbai. That, the applicant also deposited certain amount in the said account. The first informant-Branch Manager of the said bank realized the said fact and thereafter lodged the first information report. After completion of investigation the police have submitted the charge sheet on 20.2.2016. The applicant is arrested on 24.12.2015. On perusal of the charge sheet, it prima facie reveals that there is another person who helped the applicant in opening the

2 /2 BA-724-16-24 account in the complainant's bank. The amounts deposited by the applicant are freezed by the investigating agency as contemplated under Section 102 of the Cr.P.C. It further prima facie appears that the motive behind the crime is uncertain. In view of the above, I am inclined to release the applicant on bail.
Hence, the following order.
a) The applicant be released on bail in CR No.365/2015 registered with Shivaji Park Police Station, Mumbai on his furnishing PR bond of Rs.25,000/- with one or two local sureties in the like amount.
b) The applicant shall attend the concerned police station once in three months on every first Monday between 11.00a.m. to 2.0p.m. till the conclusion of trial.
c) The applicant shall deposit his passport with Shivaji Park Police Station, Mumbai during the pendency of trial. d) Application is allowed in the aforesaid terms. (A.S. GADKARI, J.)
