Heard learned counsel for the parties. We have perused the order passed by the Tribunal. Though there was a challenge to the orders passed by the Respondents in respect of deemed date of Promotion of the Petitioner, the Petitioner has failed to demonstrate the basis for the challenge and no legal submissions were advanced. The Review filed was also rejected.

Learned counsel for the Petitioner also submits that proceeding JYOTI RAJESH MANE on the basis that the orders passed in respect of the Petitioner are not by JYOTI RAJESH MANE Date: 2023.08.29 14:23:09 +0530 Jyoti Mane

2 5-WP12848-2017.doc set aside and the same stand as on date, based on the said orders, certain benefits accrue to the Petitioner and those atleast should be disbursed to the Petitioner. Learned Counsel for the Petitioner submits that based on the orders that are already passed, the Petitioner will make a representation to the Respondents. That being a position, we dispose of the Petition granting liberty to the Petitioner to make a representation as mentioned above.

If Petitioner is entitled to certain benefits based on the orders that are already been passed, which are not set aside, it is open to the Respondents to proceed to disburse the same after verifying the factual position.
