Heard Mr.Joshi, the learned counsel for the petitioner. 2.

Mr. Joshi informs the Court that the instant petition has become infructuous as RCS No. 719 of 2014, in which the impugned th February 2018 came to be passed, was disposed of order dated 28 th December 2018. The petitioner by judgment and order dated 12 preferred an appeal against the said judgment and decree, being RCA No.18 of 2019, which was also dismissed by the learned District th July 2019. The petitioner has preferred Second Appeal Judge on 20 (Stamp) No. 22485 of 2019. This Court has issued notice in the said Second Appeal.

In view of the aforesaid developments, in the intervening period, Mr.Joshi seeks leave to withdraw the petition as it has been rendered infructuous.
