The present application is restored to file today by an Order passed in Criminal Application No. 883 of 2017.

Heard the learned Counsel for the Applicant, the learned Counsel for the first informant and the learned APP. Perused the record of investigation. The learned Counsel for the Applicant submitted that as a matter of fact, the Applicant herein has settled the matter with the first informant out of the Court and the grievance of the first informant as of today does not survive. The learned Counsel for the first informant concedes to the said fact. The Applicant is charged for an offence under Section 381 of the Indian Penal Code. The said offence is compoundable with the permission of the owner Sneha Chavan 1/2

34 aba 580-17=.doc of the property stolen. In view thereof, the Applicant is granted pre-arrest bail. Hence, the following order:

i) In the event of arrest of the Applicant in C.R. No. 131 of 2016 dated 27.06.2016 registered with Kalachowki Police Station, Mumbai, the Applicant shall be released on bail on his furnishing PR Bond of Rs.10,000/- with one or two local sureties in the like amount.

ii) Applicant shall not tamper with the evidence and/or pressurize or threaten the prosecution witnesses.
