This is an application for seeking condonation of 17 days delay caused in filing criminal appeal challenging the judgment and order dated 18th December, 2019 passed by the learned Additional Sessions Judge, Thane, whereby the applicants/appellants are awarded conviction and sentence for commission of offence punishable under Section 302 of the Indian Penal Code along with fine to the tune of Rs.50,000/- each, in default of payment of fine further simple Rekha Patil 1/2

Perusal of order passed by the learned Additional Sessions Judge, Thane, dated 18th December, 2020 further shows that the applicants/ appellants are directed to pay an amount of Rs.90,000/- as compensation to the wife of the deceased and/or any other person entitled for the same as per Section 357(c) of the Code of Criminal Procedure, 1973 and it further directed to credit remaining fine amount to the Government.

In view of the above-said order, the applicants/appellants are directed to add the wife of the deceased as a party respondent to the Appeal. The necessary amendment be carried out within one week from today. For the reasons stated in the application, more particularly, at ground Nos. 9 and 10, the application is allowed. Delay is condoned. The appeal be posted for '

Admission' on 5th January, 2021.
