There is a report dated 20th April, 2017 submitted by the Registry that the files could not be traced inspite of best possible efforts. The learned counsel appearing for the petitioner is not in a position to supply a true copy of the Petition for its reconstruction. He states that he had written a letter to the petitioner but the petitioner has not responded.

Unless the petitioner responds and provides a copy of the Petition, the files cannot be reconstructed.

Therefore, we dispose of this Petition for want of prosecution. In the event, the cause of action for filing the Petition survives and the Petitioner is interested in prosecuting the same, he can always apply for restoration within a reasonable time. (A.K. MENON, J) (A.S. OKA, J)
