The Appellant wife is present in Court and is represented by her Counsel. Respondent husband is also present in Court and is appearing in person.

The challenge in the Appeal is to the judgment and decree dated 2801-2013 passed by the Family Court at Bandra, Mumbai, whereby the Petition filed by the Respondent husband was allowed and the marriage between the Respondent husband and the Appellant wife came to be dissolved.

We are informed by the learned Counsel for the Appellant wife and by Uday Prabhakar Kambli Date:

2018.08.30 12:55:38 +0530 the Respondent husband, who is appearing in person, that the parties have Uday Prabhakar Kambli Uday.P.Kambli 1/2

2/2 fca-73-13.doc amicably resolved their disputes and after the passing of the decree dated 28-01-2013 they have been residing together and they have been blessed with two daughters since.

Learned Counsel for the Appellant wife and the Respondent husband, who is appearing in person, have sought an order in invitum from this Court in the following terms:

(i) The judgment and decree dated 28-01-2013 passed by the Family Court at Bandra, Mumbai in Petition No.A-2618 of 2010 is set aside.

(ii) The marriage between the Appellant wife and the Respondent husband is restored.

(iii) We direct the Family Court at Bandra, Mumbai to keep the proceedings of Petition No.A-2618 of 2010 in a sealed envelope till such time as prescribed under the Rules. Thereafter, they may be destroyed as per Rules.
