By order dated 23rd April, 2018, the petitioner was directed to deposit Rs. 50,000/- towards costs in this Court under intimation in writing to the learned Counsel for respondent No.1. Mr. Joshi states that the petitioner has deposited Rs. 50,000/- on 3rd May, 2018 by way of demand draft. Mr. Deo confirms the said fact and seeks permission to withdraw the amount. 3.
Mr. Joshi states that respondent No.2 has made application on 28th April, 2018 for surrendering electric meter. Mr. Deo submits that in that event, respondent No.1 will apply for installation of fresh electricity meter. Statements made by learned Counsel for the parties are recorded. 4.
Respondent No.1 is permitted to withdraw Rs. 50,000/- deposited by the petitioner unconditionally. As the petitioner has handed over possession as also deposited costs of Rs. 50,000/-, nothing survives in this Petition. No further orders are necessary. Accordingly, the Petition is disposed of.
