IN THE HIGH COURT OF JUDICATURE AT BOMBAY

CIVIL APPELLATE JURISDICTION WRIT PETITION NO. 4077 OF 2014 Sou. Chhaya Sunil Deshmukh & Anr.

...Petitioners

Versus

The State of Maharashtra & Ors.

...Respondents

---------- Mr. Rahul S. Kadam, for the Petitioners.

Mr. A.P. Vanarase, AGP, for the Respondents No. 1 to 4.

---------- CORAM :

SMT. VASANTI A NAIK AND RIYAZ I. CHAGLA, JJ.

DATE :

20 November 2017 ORDER :

Heard.

Mr. Kadam, the learned counsel for the petitioners states that the caste scrutiny committee had granted a caste validity certificate to the respondent No. 6 on the same day on which the caste claim was made. It is stated that no enquiry whatsoever was conducted in the caste claim of the respondent No. 6. It is stated that a petition was filed against the respondent No.6, bearing writ petition No. 2876 of 2014, 1/2

35-1-WP-4077-14.doc challenging the very caste validity certificate issued in favour of the respondent No. 6 and the same was allowed by the order dated 9th April 2014.

Hence, for the reasons recorded in the order dated 9th April 2014 in writ petition No. 2876 of 2014, this writ petition is allowed.

Since the caste validity certificate dated 7th March 2014, issued in favour of the respondent No. 6 is already quashed and set aside by the order dated 9th April 2014 in writ petition No. 2876 of 2014, it would not be necessary to again quash the same caste validity certificate. The order passed in the writ petition No. 2876 of 2014 would govern this writ petition.

Order accordingly. No costs.
