Heard Mr.Akshay Pawar, learned counsel for the petitioner. 2.
By this Petition under Article 227 of the Constitution of India, the petitioner has challenged the judgment and order dated 21.3.2016 passed by the Appellate Bench of the Small Causes Court at Bandra, Mumbai below Exhibit-55 in Appeal No.72/2011. By that order, the Appellate Court allowed the application made by the respondent/appellant under Order VI Rule 17 of the Code of Civil Procedure, 1908 (for short, 'C.P.C.') for amending the appeal. 3.
Mr. Pawar seeks permission to withdraw this Petition on the ground that the petitioner will agitate the contentions before the Appellate Court. In view thereof, on the motion made by Mr. Pawar, the Petition is allowed to be withdrawn and is dismissed as such. Order accordingly.
