The learned counsel for the applicant submitted that there is a delay of 2 years and 202 days in filing the Appeal. He further submitted that the appeal is filed by the appellant/ opponent no.1 challenging the judgment and award dated 22nd May 2012 passed by the Motor Accident Claims Tribunal, Sangli in M.A.C.P.No. 307 of 2008. He has further submitted the appellant is a previous owner of the vehicle and it was purchased by opponent no.3 on 7th November, 2007. He has further submitted that the appellant has good case on merits and he appeared before the tribunal. The advocate, who was appearing in the tribunal, has not communicated the judgment and award passed by the tribunal and hence, the delay is caused. 1 / 2

The learned counsel for respondent no.2/ insurance company opposes this application.

In view of the submission and the reasons mentioned in the application, delay of 2 years and 202 days is condoned. 4.
Civil Application is allowed and is disposed of accordingly. 5.
