1] Heard Mr. Mundargi, learned counsel for the applicant. Heard Mrs. Tidke, learned Additional Public Prosecutor for the State.

2] In the ordinary course, the appeal is not likely to be heard within a short time. It does not appear that the applicant is likely to abscond if permitted to depart from India. In the circumstances, I am inclined to allow the application subject to certain conditions.

3] The application is allowed.

4] The applicant is permitted to depart from India and be Corrected pursuant to the order dated 06/05/2015 on the preacipe for speaking to minutes.

2/2 905 (corrected).appa475.15 away from India during the period from 25th May, 2015 to 8th June, 2015 on the following conditions:- a) The applicant shall furnish a surety in the sum of Rs.50,000/-, or deposit cash of Rs.50,000/- in lieu of surety, as and by way of additional security for his appearance before the Court;

b) The applicant shall give his travel details such as flight number, ticket number, visa particulars etc. to the investigating agency in writing, at least for 48 hours prior to his actual departure from India;

c) The applicant shall not visit any countries except those specified in para 10B of the application;

d) The applicant shall return to India by 8th June, 2015 and report the fact of his having returned to the Investigating agency within a week thereafter.

5] In view of this, there shall be no objection to issue a passport to the applicant which shall be valid for a period of one year from the date of issue.

6] The applicant shall, however, surrender the passport to the investigating agency on his return to India. 7] The application is allowed in the aforesaid terms and to the aforesaid extent.
