The application is moved for anticipatory bail. By an order dated 17th March, 2016 passed by this Court in ABA. No. 494 of 2016, this Court directed the investigating officer to give 48 hours notice to the applicant to enable him to have for proper action as at the relevant time first information report was not registered.

The learned counsel for the applicant/accused submits that now the applicant has received notice dated 1st April, 2016 that the offence under Section 376 of Indian Penal Code is registered against him vide C.R. No. 112 of 2016 at Versova police station and therefore she Vishal 1 of 2
prod-3-aba-609-2016.doc approached this Court. On query it is informed that the applicant did not file application before the Sessions Court.

Hence, the applicant/accused is directed to move the Sessions Court for anticipatory bail. However, till then in view of the earlier order of this Court, the applicant/accused is protected from arrest till 5th April, 2016.

The application stands disposed of accordingly.
