This is an application for condonation of delay of 90 days and for restoration of Writ Petition No.1463 of 2013 which was dismissed for non prosecution. Mr. Rajure, learned counsel appearing for the respondent No.2 opposed the application. However, for the reasons stated in the application and in the interest of justice delay of 90 days is condoned and the Writ Petition No.1463/2013 is restored to the file subject to the condition that the applicant shall pay costs of Rs.1000/- to the Maharashtra State Legal Service Authority within a period of four weeks from today. The payment of costs is condition precedent for condonation of delay and for restoration of the writ petition. Application is allowed in terms of prayer clause (a).
