Present Petition is filed for quashing for FIR No. 141 of 2017 dated 6th April, 2017, registered with Khar Police Station, Mumbai under Section 376 of the Indian Penal Code.

At the outset, learned APP submitted that, in the present case after completion of investigation Police have submitted charge-sheet on 19th April, 2018 in the Court of Metropolitan Magistrate, 9th Court, Bandra, Mumbai bearing Sessions Case No. 470 of 2018. That, the trial Court has now scheduled the said case for framing of charge on 28th April, 2023. 3.

In view thereof, learned Advocate for Petitioner on instructions seeks leave to withdraw present Petition with liberty to file an Application for discharge as contemplated under Section 227 of the Code of Criminal 1/2

Leave and liberty granted.
