The Learned Counsel for the Petitioner on instructions of the Petitioner who is personally present in Court states that the Petitioner would not press the above Petition. However, direction may be issued to the Collector, Pune, to dispose of the Appeal filed by the Petitioner within the time frame stipulated by Section 35(3-B) of the Maharashtra Village Panchayats Act, 1958 (For short "the said Act"). The above Petition has been filed against the order dated 22.03.2016 rejecting the application of stay filed by the Petitioner against the "No Confidence Motion" passed against her. In my view, having regard to the mandate of Section 35(3-B) BGP.

(911)-WPST-10160-16.doc of the said Act, it would be just and proper to direct the Collector, Pune, to dispose of the dispute application filed by the Petitioner latest by 25.04.2016. In view of what is posited in Section 35(3) read with the first proviso thereto, the elections to the post of Sarpanch not to be held till the dispute application filed by the Petitioner is decided. The Petitioner would appear before the Collector on 11.04.2016 when the dispute application is already fixed for hearing. The Petitioner to draw the Collector's attention to the developments in the above Petition by producing a copy of this order. The Petition is accordingly disposed of as not pressed. 2.

Needless to state that the contentions of the Petitioner are kept open for being urged before the Collector, Pune. [R.M. SAVANT, J] BGP.
