Heard, Mr Thakur, the learned counsel for the Petitioner, Ms Shinde, learned APP for the State and Mr Modi, the learned counsel for the Respondent No.2.

The Petitioner by this Petition seeks transfer of the investigation in respect of M.E.C.R. No. 15 of 2016 registered with the Vakola Police Station to some other investigating agency.

The Senior Police Inspector, Vakola Police Station, Mumbai has 1/2

jsn 36-wp-1484-2017.doc filed report dated 19th April 2017. The said report shows that the investigation is started. The report further shows that the investigating officer has recorded statements of various witnesses and that the disputed conveyance deed is also taken into possession and specimen signatures are also obtained.

The learned APP for the State upon instructions states that this fact shows that investigation is in progress. 5.

We, therefore, are not inclined to transfer the investigation of subject FIR. However, in the light of allegations we direct the Assistant Commissioner of Police, Vakola Division to supervise the investigation of the subject FIR. The Vakola Police is also directed to expedite investigation and file report of the same.
