Perused the order of this Court dated 29th June, 2022. It is observed by the Division Bench in the order that the perusal of the record indicates that eligibility of the petitioner-society for allotment of plots is not in dispute. Then, in paragraph No.3, the Division Bench of this Court directed Collector, Nashik, to undertake certain exercise. In paragraph 5 of the order, the Division Bench observed thus : "5.

It is made clear that the learned Collector shall pass a fresh order without being influenced by the observations made and the conclusion drawn in the impugned order, which is the subject matter of this Petition."

Learned AGP today placed on record, a copy of the communication addressed to learned AGP as well as copy of the order dated 21st July, 2022, passed by the District Collector, Nashik. Perusal of the order dated 21st July, 2022, shows that relying on certain Government Resolutions as well as orders passed by the Hon'ble Apex Court, the District Collector, Nashik, disposed of the application filed at the instance of the petitioner. A copy of the order further shows that the copy of the order is forwarded to the petitioner, who is the chairman of the society, Secretary - Shri Raju Daware and to learned Additional GP. Thus, in our opinion, the order of the Division Bench dated 29th June, 2022 is duly complied with. Accordingly, the petition is disposed of. 3.

In case the petitioner is having any grievance against the order dated 21st July, 2022, he is at liberty to avail appropriate remedies as available under law including approaching the competent forum, judicial or quasi-judicial as the case may be.

Needless to state that the contentions of the respective parties raised in the above petition are kept open.
