By this application, applicant is seeking bail in C.R. No. 297 of 2021 registered with V.B.Nagar Police Station, Mumbai, for offences punishable under Sections 364, 302, 328, 201, 202 and 212 read with Section 34 of the Indian Penal Code, 1860 (for short "IPC").

It is prosecution's case that complainant, sister of the deceased, had lodged missing complaint of her brother Kotya with SHUBHADA SHANKAR KADAM police as he was not traceable. In investigation, it was revealed that the applicant along with co-accused murdered the deceased - SHUBHADA SHANKAR KADAM Date: 2024.05.04 16:06:28 +0530 Kotya by giving sleeping pill in his tea and he was stabbed to death. 1/3
In investigation, it was revealed that the applicant and other coaccused stabbed the deceased - Kotya. 3.
It is contention of learned counsel for the applicant that this Court has released the co-accused - Kishor Pramod Sahe @ Kamal Kishore Sahu on bail. The role attributed to Kishor Sahe and the present applicant is same, hence, applicant is entitled for bail on the principle of parity.

Learned APP fairly submitted that the role attributed to the co-accused - Kishor Sahe and applicant is same. 5.
Considering the submissions of both learned counsel as well as the co-accused- Kishor Sahe, against whom same allegations are leveled like the applicant, has been released on bail by this Court, the applicant is entitled for bail on the principle of parity.

In view of above, I pass following order.
ORDER
(i) The applicant - Vishal Raju Karade be released on bail in C.R. No. 297 of 2021 registered with V. B. Nagar Police Station, Mumbai on executing P.R. Bond in the sum of Rs. 25,000/- with one or two sureties in the like amount. 2/3
(ii) The applicant shall attend the concerned police station once in a month i.e. on first Monday between 11:00 a.m. to 2:00 p.m. till framing of charge.
(iii) The applicant shall inform his latest place of residence and mobile number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Investigating Officer.
(iv) Applicant shall not tamper with the evidence or attempt to influence or contact the complainant, witnesses or any person concerned with the case.

The application is allowed in the aforesaid terms and is accordingly disposed of.
