This is an application through jail.
The applicant is seeking temporary bail on the ground, that his mother is suffering from Ischaemic Heart Disease and requires immediate operation for the same. The said Certificate is dated 15.03.2015.
3.
Learned APP has produced a copy of the order dated 13.03.2015, passed by this Court (CORAM : A.R.JOSHI, J.) rejecting the applicant's application for bail. From the said order, it is apparent that even the earlier bail application of the applicant was disposed of by this Court (Coram : A.R.JOSHI, J.), after recording that as the Court was not inclined to grant bail to the applicant, the bail applications were withdrawn. However, by the said order dated 13.03.2015 this Court observed that as the Court had come to the conclusion that no case for bail was made out, no different view can be taken. However, this Court expedited the trial and directed the Trial Court to dispose of the R.C.C.No.364 of 2013 as expeditiously as possible and dismissed the applicant's bail application. Learned APP tendered a Certificate issued by the Civil Surgeon, General Hospital, Malegaon, District -
Nasik. In the said Certificate, it is stated that Sayerabano (applicant's mother) was examined and she was found to be suffering from Ischaemic Heart Disease and was advised rest. It is further stated that she is alright and can seek the opinion of a Cardiologist. The said Certificate is dated 29.07.2015. A copy of the said Certificate is taken on record and marked as "X" for identification. As of today, in view of the Certificate dated 29.07.2015, no ground is made out by the applicant to enlarge him on a temporary bail.

The Application is disposed of accordingly.
