This Application is for stay of the operation and implementation of the impugned judgment and award dated 03/12/2011 passed by the learned Member, MACT, Pune in MACP No.29/2008.

The learned counsel for the Respondent claimant submits that pursuant to the order dated 27/04/2012 passed by this court the Applicant Insurance Co. deposited the entire awarded amount in the Tribunal. Statement is accepted. Basavraj G Patil 1/2

Considering submissions made by the learned counsel for the Applicant and the averments made in the Application, I am satisfied that the Applicant has made out a case to confirm the ad-interim relief granted by this court on 27/04/2012.

Hence, the following order:

a) Civil Application is allowed in terms of prayer clause (a) which reads thus:

(a) That pending hearing and final disposal of the present First Appeal, the effect, operation, implementation and execution of the impugned judgment and award dated 03/12/2011 passed by the learned member, MACT, Pune in MACP No.29/2008 and disbursal of amount thereunder, be kindly stayed.

b) Civil Application stands disposed off accordingly.
