The petition is filed seeking direction to the Magistrate. The petitioner has invoked supervisory jurisdiction of this Court. Proper remedy for the petitioner is to file an application for expeditious trial before the Magistrate. The Magistrate will furnish detail reasons while deciding the application for expeditious trial, so that the superior will have benefit/advantage of such reasons while adjudicating the matter. In absence of such exercise, it is not possible for this Court to consider the case of the petitioner based on grounds made out in the petition.

The writ petition is disposed of with liberty to petitioner to file an application for expeditious trial before the Magistrate. If such an application is filed by the petitioner, learned Magistrate shall decide the same within two weeks from today. (AMIT BORKAR, J.)
