Heard Mr. Agarwal, Advocate for Petitioners and Mr. Jaibhave, learned Advocate for Respondents.

Both the learned Advocates have jointly placed on record Affidavit dated 14.03.2024 filed by Tarabai Pandit Bhandure who is Petitioner No.1. Petitioner No.1 is present before me and confirms execution of Affidavit dated 14.03.2024. The Affidavit dated 14.03.2024 is taken on record.

Paragraph No.4 of the Affidavit states that Petitioner Nos.2, 3 and 4 who are Plaintiff Nos.2, 3 and 4 have given Power of Attorney dated 13.03.2024 in favour of Petitioner No.1 to act as their constituted Power of Attorney.

It is stated in Affidavit that parties have decided to amicably settle their disputes and in view thereof the Plaintiffs will withdraw Special Civil Suit No.383 of 2007 pending before Civil Judge Senior Division, Nashik in view of the Consent Terms which shall be filed by the parties before the Trial Court.

In view of the above, Affidavit dated 14.03.2024 and the statement made therein, the Writ Petition is permitted and allowed to be withdrawn.
