The learned counsel for the petitioners seeks time.

The only substantive prayer in this petition is in terms of prayer clause (b) which reads thus:

"b) The further proceedings of Recovery Proceeding No.17.2010 pending on the file of the Recovery Officer, Debts Recovery Tribunal, Pune and auction sale pursuant to the said recovery proceeding be stayed till the hearing and final disposal of Appeal No.77/2011 pending on the file of Debts Recovery Appellate Tribunal, Mumbai and for that

wp5283 purpose appropriate writ, order and/or direction be issued."

Perusal of the Farad Sheet shows that from the year 2013, this Court has not granted any ad-interim relief.

If the appeal is still pending before the DRAT, the remedy of the petitioner is to seek appropriate relief in the pending appeal.

Subject to observations made above, writ petition is disposed of. All contentions on merits are kept open.
