After hearing the arguments of the learned Advocate for the Applicant and learned APP, when this Court has expressed an opinion that no case for grant of anticipatory bail is made out, learned Advocate for the Applicant seeks liberty to withdraw the application. Liberty granted. Anticipatory bail application is disposed of as withdrawn.

Learned Advocate for the Applicant tried her level best to convince this Court. My attention was also invited to the injuries sustained by Aaksah Arjun Tiwari, who is brother of the Applicant, the relevant papers are on page no. 56 forwarding letter, page no. 57 Digitally signed by SEEMA KSHITIJ YELKAR Date:

ABA 949 of 2023.doc certificate and page no. 66 copy of the complaint filed by the Arjun Shamsundar Tiwari-father of the present Applicant to the local Police Station and Police Superintendent, wherein father has made complaint against the first informant and the other relatives. This Court has also made query with the learned APP as to whether any action is taken on the basis of all these documents, it was told that the present investigating officer is new and he is no aware about action taken by the earlier investigating officer because those documents are of the year 2019.

These documents suggest that they are arising from the said incident. Even though it may be true, on the other aspect Court find that case is not made out for anticipatory bail. Hence anticipatory bail application is disposed of. [S. M. MODAK, J.] Seema 2/2
