This is an application under Section 438 of Code of Criminal Procedure for anticipatory bail.

The applicant is apprehending her arrest in Crime No. 72 of 2023 registered at Shikrapur Police Station, Pune (Rural) for the ofence punishable under Section 328 of the Indian Penal Code and Section 65F of the Maharashtra Prohibition Act. 3.

On 27 January 2023, pursuant to secrete information raid was conducted and the applicant was found to be distilling illicit liquor. According to the prosecution, the applicant could not be apprehended as she ran away from the place of incident. 4.

I have heard the learned counsel appearing for the applicant and the learned APP for the respondent / State. Dinesh S. Sherla 1/2

There appears to be no need of custodial interrogation of the applicant. Considering the facts and circumstances, I am inclined to release the applicant on anticipatory bail. In the result the following order is passed.

ORDER

A) The Application is allowed.

B) In the event of arrest of the applicant in C.R. No. 72 of 2023 registered at Shikrapur Police Station, Pune (Rural) for the ofence punishable under Section 328 of the Indian Penal Code and Section 65F of the Maharashtra Prohibition Act, she be released on bail on executing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.

C) The applicant shall attend the concerned police station once in a month, i.e., on frst Saturday between 11:00 a.m. to 2:00 p.m. till conclusion of trial.

E] The prosecution is at liberty to fle an application for cancellation of bail, if the applicant commits similar ofence. [N.R.BORKAR, J.] Dinesh S. Sherla 2/2
