1] Respondent No.1 in this petition is expired on 15th December, 2008. His legal representatives have taken out this Civil Application for bringing themselves on record. Infact it was the duty of the petitioner to bring the legal heirs of deceased Manohar Maruti Chavan on record. However, now that the legal representatives have themselves applied that they 1/2
osk 127-caw-103-2016.odt be brought on record and Mr.Bapat, learned counsel for the original petitioner supports such application, the same is made absolute in terms of prayer Clause (b). There is no question of any condonation of delay because this is not an application made by the original petitioner.
2] The original petitioner to however, make necessary amendment to the cause title within a period of four weeks from today. In case, the necessary amendment is not carried out, this petition shall stand dismissed as against the legal representatives of deceased Manohar Maruti Chavan. 3] Considering that the petition is of the year 2004, place the same for final disposal in the week commencing from 8th August, 2016.
4] This Civil Application is disposed of in the aforesaid terms.
